Terms of Service

1. Acceptance of Terms

By accessing, downloading, installing, or using the Zeryth Browser ("Software") and related services ("Services") provided by Zeryth Technologies ("Zeryth", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Software on behalf of an organization, institution, or testing body, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you may not use the Software.

2. License Grant and Restrictions

Subject to your compliance with these Terms, Zeryth grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Software solely for its intended purpose of conducting or participating in secure, proctored assessments.

You agree that you will not:

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software.
  • Modify, adapt, alter, or create derivative works from the Software.
  • Attempt to bypass, exploit, or disable any security, anti-cheat, or proctoring mechanisms within the Software.
  • Use the Software for any illegal, unauthorized, or malicious purpose.
  • Sublicense, resell, or distribute the Software without explicit written permission from Zeryth Technologies.

3. Proctored Environment and Monitoring

Zeryth Browser is specifically designed to create a secure, restricted environment for online assessments. By using the Software during a designated session, you acknowledge and agree that:

  • The Software will actively monitor and restrict access to other applications, virtual machines, secondary displays, and unauthorized peripherals.
  • The Software may monitor system processes, clipboard activity, screen contents, and network traffic to detect prohibited behavior.
  • Attempting to circumvent these restrictions may result in immediate termination of your session and notification to the administering institution.

4. Account and Security

Certain features of the Services may require you to create an account or provide authentication tokens. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Zeryth reserves the right to suspend or terminate accounts that exhibit suspicious, fraudulent, or abusive behavior.

5. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ZERYTH DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

6. Limitation of Liability

IN NO EVENT SHALL ZERYTH TECHNOLOGIES, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SOFTWARE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

7. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Software after those revisions become effective, you agree to be bound by the revised terms.
